These Terms and Conditions govern your use of The High Performance Guide website (www.thehighperformanceguide.com), the HHP Scorecard, and any services offered by High Performance Guide BV. By accessing the website or using any of our tools or services, you agree to these terms. Please read them carefully.
These are Version 1.0 terms, designed to provide a solid legal foundation from launch. They will be expanded as specific services and programmes are further developed and launched.

2. Definitions
In these Terms and Conditions, the following terms have the following meanings:
– "THPG" or "we" or "us" means High Performance Guide BV.
– "You" or "User" means any person accessing the website, using the HHP Scorecard, or purchasing services.
– "Services" means all offerings provided by THPG, including but not limited to the website, HHP Scorecard, coaching programmes, training, workshops, group programmes, membership, newsletters, and any digital content.
– "HHP Scorecard" means the free online self-assessment tool provided by THPG as a lead generation and educational tool.
– "HHP Framework" means the High Human Performance framework developed by THPG, including its components, concepts, and related intellectual property.
– "Content" means all materials published on the website or delivered through our services, including articles, frameworks, downloadable resources, assessments, and course materials.
– "Personal Data" has the meaning given under applicable data protection law, including the General Data Protection Regulation (GDPR).
– "Distance Contract" means a contract concluded between THPG and a consumer entirely through remote communication (online, email, phone), as defined under applicable EU consumer law.
– "Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession.
3. Scope and Acceptance
3.1. These Terms and Conditions apply to all use of the THPG website, the HHP Scorecard, and any services offered by THPG, whether free or paid.
3.2. By accessing the website or using any THPG service, you agree to these terms in full. If you do not agree, please do not use our website or services.
3.3. These terms may be supplemented by additional terms specific to particular services (such as a coaching agreement or programme enrolment agreement). Where additional terms apply, they will be presented to you before purchase or enrolment and will take precedence over these general terms in the event of any conflict.
3.4. THPG reserves the right to update these terms at any time. Updates will be published on the website with a revised date. Continued use of the website or services after publication of updated terms constitutes acceptance of those changes.
3.5. The English version of these terms is the authoritative version. If a Dutch translation is made available at any time, the English text governs in the event of any conflict.
4. Website and HHP Scorecard
4.1 Website Access
4.1.1. Access to the THPG website is provided free of charge and on an "as is" and "as available" basis. THPG does not guarantee uninterrupted or error-free access and may suspend, modify, or discontinue any part of the website at any time without notice.
4.1.2. You must not use the website for any unlawful purpose, or in any way that infringes the rights of others.
4.2 HHP Scorecard
4.2.1. The HHP Scorecard is a free self-assessment tool designed for educational and informational purposes. It is a marketing and lead generation tool that provides indicative insights based on your self-reported responses.
4.2.2. The HHP Scorecard is not a clinical assessment, psychological diagnostic tool, or substitute for professional advice of any kind, including medical, psychological, career, legal, or financial advice.
4.2.3. Scorecard results are based on your own input and reflect your self-perception at the time of completion. THPG makes no representations as to the accuracy, completeness, or fitness for any particular purpose of the results.
4.2.4. By completing the HHP Scorecard, you consent to THPG processing your responses and contact details in accordance with our Privacy Policy, and to receiving your Scorecard results by email.
4.2.5. THPG reserves the right to modify, suspend, or discontinue the HHP Scorecard at any time.
5. Services
5.1 Nature of Services
5.1.1. THPG currently offers coaching, training and consulting based on a combination of the Certified High Performance Coaching (CHPC) methodology, developed by the High Performance Institute, and THPG's own independently developed frameworks, concepts, tools, and practices — including the High Human Performance (HHP) Framework. THPG is an independently certified coach and is not an official representative or agent of the High Performance Institute.
5.1.2. Additional services, including group coaching programmes, intensive workshops, online training programmes, membership tiers, and a newsletter, are in development and will be subject to their own terms when launched.
5.2 Effort Obligation
5.2.1. All coaching and training services provided by THPG constitute an effort obligation (Dutch: inspanningsverplichting), not a results obligation. THPG commits to delivering services with professional care and competence. Outcomes depend on many individual factors, including the effort, engagement, and circumstances of each client, and cannot be guaranteed.
5.2.2. THPG does not guarantee specific outcomes, transformations, career results, financial results, or any other personal or professional outcomes as a result of participating in coaching or training.
5.3 Not Professional Advice
5.3.1. Coaching and training provided by THPG is not therapy, psychological treatment, medical advice, legal advice, or financial advice. If you require support of that nature, you should seek qualified professional help.
6. Pricing and Payment
6.1. All prices are stated in euros (EUR), exclusive of VAT (BTW) unless otherwise stated. Applicable VAT will be added where required by law.
6.2. Pricing for services is provided on request and agreed in writing prior to commencement of any paid engagement. Quoted prices apply to the specific engagement for which they were provided and do not bind THPG for future engagements. THPG reserves the right to revise its pricing at any time.
6.3. Payment for paid services is due in advance, as specified at the point of purchase or in the applicable service agreement.
6.4. Invoices are payable within 14 calendar days of the invoice date, unless otherwise specified. In the event of late payment, statutory commercial interest (wettelijke handelsrente) applies from the due date, without the need for further notice.
6.5. If you believe an invoice contains an error, please contact us within 7 days of receipt.
7. Cancellation and Refunds
7.1 Cooling-Off Right for Consumers
7.1.1. Where applicable under EU consumer law, consumers have a 14-day right of withdrawal from the date of purchase. Upon payment, access to digital content or commencement of a service is granted immediately. At the point of purchase, you will be asked to explicitly confirm that you understand this waives your right of withdrawal. Once access has been granted or the service has commenced, the cooling-off right no longer applies.

7.2 1:1 Coaching Sessions
7.2.1. Individual coaching sessions may be rescheduled or cancelled with at least 48 hours' notice prior to the scheduled session time, at no charge.
7.2.2. Cancellations made with less than 48 hours' notice, or non-attendance without notice, will be charged at the full session rate.
7.3 Programmes and Packages
7.3.1. Specific cancellation and refund terms for multi-session programmes, group programmes, workshops, and other packaged services will be set out in the applicable service agreement or programme terms, presented at the point of enrolment.
7.3.2. As a general principle: once a programme has commenced, THPG does not offer refunds for the unused portion unless exceptional circumstances apply at THPG's sole discretion.
7.4 Membership (Future)
7.4.1. When membership tiers are launched, the specific refund and cancellation terms will be published as part of the membership terms. Monthly memberships will generally be non-refundable, with the right to cancel at any time effective at the end of the current billing period. Annual memberships will include a short refund window upon joining, as detailed in the membership terms.
7.5 Cancellation by THPG
7.5.1. THPG reserves the right to cancel or reschedule a session, programme, or event. In the event of cancellation by THPG, you will receive a full refund of amounts paid for the cancelled service, or the option to reschedule at no additional cost.
8. Intellectual Property
8.1. All content on the THPG website, including but not limited to the HHP Framework, the HHP Scorecard (including its structure, questions, and scoring logic), articles, frameworks, course materials, downloadable resources, brand assets, and other materials, is the intellectual property of High Performance Guide BV or is used under licence.
8.2. You may access and use THPG content for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, adapt, publish, translate, create derivative works from, or commercially exploit any THPG content without prior written permission.
8.3. Nothing in these terms transfers any intellectual property rights to you. Any rights not expressly granted are reserved.
8.4. THPG's coaching methodology draws on the Certified High Performance Coaching (CHPC) certification framework developed by the High Performance Institute. This certification is the intellectual property of the High Performance Institute. THPG makes no claim to ownership of that methodology.
9. Confidentiality
9.1. THPG treats all information shared in the context of coaching, training, and client engagements as strictly confidential. Information shared by clients will not be disclosed to third parties without consent, except where required by law.
9.2. In group coaching settings, workshops, or community programmes, all participants will be asked to agree to group confidentiality. THPG cannot be held responsible for the conduct of other participants.
9.3. Clients are also expected to treat any proprietary materials, frameworks, or processes shared during coaching or training engagements as confidential and not for redistribution.
10. Personal Data and Privacy
10.1. THPG processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch data protection law.
10.2. Personal data is collected through the website, HHP Scorecard, service enquiries, and client engagements. It is used to deliver services, communicate with you, and, where you have given consent, to send marketing communications.
10.3. You have the right at any time to access, correct, or request deletion of your personal data. You may also withdraw consent for marketing communications at any time.
10.4. Full details of how THPG collects, uses, stores, and protects your personal data are set out in the THPG Privacy Policy, available at www.thehighperformanceguide.com/privacy-policy. The Privacy Policy forms part of these terms.
10.5. THPG uses third-party platforms and tools to deliver services (such as scheduling tools, email platforms, and payment processors). These act as data processors and are bound by appropriate data protection obligations. THPG is not responsible for the independent data practices of those platforms.
11. Limitation of Liability
11.1. To the maximum extent permitted by applicable law, THPG's total liability for any claim arising from or in connection with these terms or the services provided shall not exceed the total amount paid by you to THPG in the three months preceding the claim.
11.2. THPG is not liable for any indirect, consequential, incidental, or special loss or damage, including but not limited to loss of income, loss of profit, loss of opportunity, or loss of data.
11.3. THPG is not liable for any outcomes, decisions, or actions taken by you as a result of coaching, training, assessment results, or content consumed through THPG services.
11.4. Nothing in these terms excludes or limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under Dutch law.
12. Third-Party Platforms and Links
12.1. The THPG website may contain links to third-party websites or reference third-party tools and services. These are provided for convenience only. THPG does not endorse, control, or accept responsibility for the content or practices of any third-party website or service.
12.2. Your use of any third-party platform or service accessed through THPG is subject to that platform's own terms and conditions.
13. Governing Law and Disputes
13.1. These terms are governed by and construed in accordance with Dutch law.
13.2. Any disputes arising from or in connection with these terms or the services provided by THPG shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
13.3. If you are a consumer resident in another EU member state, you retain the right to rely on any mandatory consumer protection provisions applicable in your country of residence that offer a higher level of protection than Dutch law.
13.4. Before initiating formal proceedings, both parties agree to make a good-faith effort to resolve any dispute informally by contacting THPG at [email protected]. THPG will aim to respond to complaints within 14 calendar days.
14. General Provisions
14.1. If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining terms shall continue in full force and effect.
14.2. THPG's failure to enforce any right or provision under these terms does not constitute a waiver of that right or provision.
14.3. These terms constitute the entire agreement between you and THPG regarding their subject matter, and supersede any prior agreements or representations, unless supplemented by a specific service agreement.
14.4. THPG may assign its rights and obligations under these terms to any successor entity or in the event of a business transfer. You may not assign your rights or obligations without THPG's prior written consent.
